GENERAL TERMS AND CONDITIONS

This agreement regulates the general conditions of purchase of various items offered on this website for Nutri-Cosmetica.com with CIF 37786702W and address at Calle Rafael Casanovas 13, CP Lliçà d'Amunt 08186 Barcelona - Spain (hereinafter Nutri-Cosmetica.com).

The Customer, upon completing the registration process, and purchase any of our products, expressly consent and submit to the terms specified below, and to the conditions of access and use of our website and its privacy policy, accessible through the link "Legal Notices".

The Customer acknowledges having legal capacity to be bound contractually.

This contract is permanently available in the legal notices on our website, and can be downloaded in PDF format at the time of recruitment.

1. Prices

In consideration for the purchased product, the Customer expressly agrees to pay specified amounts to Nutri-Cosmetica.com at the time of purchase on the price relationship established at the web www.nutri-cosmetica.com.

Prices listed are based on the chosen product. Articles may correspond to our current catalog as well as items with lower prices because of discounts on certain selected products or special offers or promotions. Previous to the Customer confirmation of your order and prior to payment of the products, the screen will show the final purchase price. The final price is the total price of the product including VAT (Value Added Tax) and is broken down into price without VAT, taxes, transportation (if applicable) and total price including VAT. Payments made at Canary Islands, Ceuta and Melilla or outside the European Union are VAT excluded, but may be subject to taxes or other obligations that will be included in the final payment. Does not include anything that is not specified in the description as included.

Packaging costs and management are included in the product price. The shipping and handling costs resulting from product delivery are not included in the prices and may vary depending on the destination and total amount of the order. At the end of the buying process and prior to payment, the system shall specify the shipping costs depending on the delivery destination and the type chosen. These expenses shall not apply in those goods delivered to store. In certain purchases and considering the amount of product units purchased, and complimentary shipping will be free.


2. Purchasing procedure

On our website you can see all our products individually. The procedure for making and managing the purchase will indicate on the website and should only be followed the following steps:

  • Choose the product and see the one that has interested.

3. Availability, preparation and shipment

The products offered by our shop are always subject to availability.

As soon as a lack of stock is detected it will be notified at our website and will be communicated to our customers if it affects to their orders.

In cases where the product is sold without the possibility of a stock replacement, the customer will be informed and we will offer an alternative product with similar specs and quality in comparison with the purchased item. If, despite this, the customer is not interested in accepting the alternative, Nutri-Cosmetica.com will offer the corresponding refund.

3.1 Preparation of the order

In the event that the products are available in stock, they will be prepared to be sent within approximately 24 working hours from payment confirmation.

In case a product is not available immediately, there is an estimated period of time within about 24 to 72 working hours since payment confirmation to proceed with the replacement of the stock from our suppliers to proceed with the preparation of the order.

For higher delays we will notify the customer and it could also be indicated on the corresponding product page.

3.2 Shipping

The products offered by Nutri-Cosmetica.com online store are available for distribution in:

Spain (Canary Islands, Ceuta and Melilla), member states of the European, American and Asian Union.

The delivery of the purchased products are made ​​to the address indicated in the order by the customer and may include a delivery note if the customer request it. Also, at any time the customer has the ability to query the billing info by accessing to his personal account on our website and using electronic invoice format (PDF) for downloading if he desires.

3.2.1 Delivery times and monitoring

Delivery times are always approximate as they depend o factors beyound our service, however below there is a list of approximate delivery times for shipments:

  • Around 48 working hours from the date of dispatch, if delivery must take place in Spain.
  • Around 72 working hours  from the date of dispatch, if delivery must take place in Spain outside the Peninsula.
  • Aproximately between 5 and 10 working days from the date of delivery in case of destination placed at European countries.
  • Aproximately between 10 and 25 working days from the date of delivery in case of destination placed in countries outside the European Union.
  • In case of "Pick up store *" option, the customer is able to take the order during working days from Monday to Friday.

*- Pick up store option is only available for Spain's customers

In the case of shipments by Express delivery services, the previous delivery times can be reduced by about half.

3.2.2 Shipping Tracking

To keep informed about the order status, the customer will receive by mail a confirmation of the order and payments, as well as the time that it will proceed to be shipped.  Customer can check the shipping status by accessing the customer account (Orders history) through our online store.

Our shop also provides with an online tracking service to check the status of shipment. The information of the tracking system is automated and based on the data provided by the chosen agency of transport or postal service from the destination country. The reliability and updating of this data is responsibility of the shipping service selected by the customer.

Our shipments include transport insurance, so that if the merchandise is damaged or lost during shipment, the customer is entitled to the corresponding reimbursement.

No deliveries outside the weekdays will be made, so it is recommended that the customer informs us regarding their preferences for delivery times by using the "Comments" section that appears while providing the information requested on the shipping info. The customer must assume that this info is not always possible to be included in their shipping, as it depends on the delivery service.

3.2.3 Shipping troubleshooting

Shipping costs are detailed in the order before its confirmation, the calculation is estimated and based on the delivery destination and the chosen shipping method.

In certain cases our store can provide free shipping service depending on different promotions and subject to the conditions and terms of service.

The delivery times of any order displayed on the website of Nutri-Cosmetica.com are always approximate. Nutri-Cosmetica.com is not responsible for delays due to slow operation of the shipping process employed by the carrier or because of delays due to customs reasons.

In any case Nutri-Cosmetica.com will provide to the customer as many information as possible regarding the status of the package as well as to process a claim in case of problems during the delivery process or in case of a shipment loss.

In the event that an order is returned due to any delivery problems which are unrelated to the service of our shop, the costs of performing a shipping forwarding or cancelling the order shall be borne by the customer. In case of free shipping promotions, the customer will assume the actual shipping costs of any cancellation or any new shipping.

4. Payment and payment periods

We accept the following payment methods:

  • Credit Card, Multisafepay and Paypal: The transaction is done by connecting directly through the the bank virtual payment gateway, Multisafepay or Paypal services. The payment will be processed immediately if the customer completes the checkout process. After the payment is confirmed, the order will initiate its preparation process (only on working days) and it will be shipped to the delivery adress by the shipping method chosen by the customer during the check out process. 
  • Bank wire (bank transfer) or deposit account: This payment is made through bank wire or direct deposit into the account number of CATALUNYACAIXA. The bank payment details are shown on the screen after the order confirmation and are also sent by email to the customer. The order will be processed as soon as Nutri-Cosmetica.com received the payment confirmation. On working days, after 24 hours from the payment confirmation, the shipment will be made for delivery by the chosen shipment mode (the order will be shipped the indicated delivery address or it will be delivered by store pickup). In case of bank wire payment, the order will remain awaiting for payment during one week. If the payment is not confirmed during this period of time, then Nutri-Cosmetica.com reserves its right to cancel the order without any notification to the customer.
  • Payment in cash: payment in cash is only available in cases of picking the order in our store.


Nutri-Cosmetica.com doesn't keep or access to the customer's credit card or bank data. All our payment systems are completely safe and certified.

Payments are done before product delivery, so Nutri-Cosmetica.com will not provide the requested product or products until the payment is confirmed. The order will be processed for its preparation and shipment within approximately 24 working hours from the confirmation of the payment, whatever the mode of payment that has been used by the Customer. Nutri-Cosmetica.com reserves the right to temporarily or permanently cancel the provided services due to any incident related with the payment process.

5. Taxes

Prices shown on the website include VAT (21% or 10% according article) as appropriate. On orders placed by customers in the Canary Islands, Ceuta and Melilla are not charged VAT but orders may be subject to import duties and / or local customs as well as delivery rates assume full costing the customer.

In the case of supply of goods to customers with shipping addresses within a Member State of the European Union, VAT will match the destination country and will be reflected on the order summary in the e-mail confirmation and on the invoice. The prices include the VAT rate that is routinely applied to real products to countries of the European Union, although some may be subject to specific variations. Similarly, it is also possible to vary the VAT on shipping costs apply to the order.

The prices of the products delivered to countries outside the European Union will not be charged with VAT but orders may be subject to export duties and/or customs to be determined according to the legislation of the destination country. Those will be applied when orders arriving at customs from their destination. Some estimated customs fees will be charged in the price, so output customs charges may be applied in the cost of transportation, however the customer assumes the costs and corresponding taxes in the customs from the country of delivery. Customer shall bear both customs duties as managing the necessary steps for payment to the competent authorities of their countries.

Under no circumstances we will accept returns based on the failure by the Customer with customs duties or export taxes of their own countries.

6. Invoices

When make payment and after choosing the option of receiving billing information, you will receive an Invoice in PDF format at the email address that you have indicated to that effect. In addition, you also receive the invoice on paper in the same shipment.

The Customer is responsible for confirming the receipt of notifications and put our knowledge any changes on your data, Nutri-Cosmetica.com being exempt from any liability for this circumstance.

7. Warranty

In view of the nature of our products (cosmetics and pharmacy), they are secured in normal storage conditions until the expiration date on the package itself properly. The warranty covers only manufacturing defects (product expired, damaged or in poor condition). It does not cover improper use or others that are not attributable to a defect in the vendor or a defect in the product. In these cases, the Customer will return the product and we'll replace it.

If the Customer is resident in another EU country, may apply directly to the manufacturer or importer of the product, but may be sent to our offices to be subsequently redirected to the supplier.

The guarantee document is the invoice, you will receive by e-mail to make the payment and on paper to receive the product (optional).

Transport costs generated by the warranty returns will be paid by the Customer.

8. Returns (RMA)

8.1 Return due to product conditions

At the time of receiving an order, the customer should check its status to notify any of the following issues:

  • Errors related with product reference or quantities
  • Expired products
  • Damaged or poor condition products due to shipping process

In the above cases, the shipping costs will be assumed by Nutri-Cosmetica.com or will be assumed by the customer and subsequently paid by Nutri-Cosmetica.com. In any case the shipping method will be equivalent to the lowest possible cost within the range of shipments at the time of purchase. In case in which the customer decided to use a different return shippment, the additional costs will be assumed by the customer.

It is advisable to provide with graphic media of the issue to facilitate the returning process.

At the previous cases, if possible, Nutri-Cosmetica.com will offer a product replacement as an alternative at no extra cost and without right, by the Customer, to any compensation.

In any case, the return will always be subject to a prior review by Nutri-Cosmetica.com to check and verify the application of the requirements and conditions of the return, as established during the sale. Upon receipt of the returned item if a refund is applicable, then it will be applied on the same terms that were used to make the payment.

8.2 Return Order cancellation motivated by

From the moment of confirmation of an order, the customer is entitled to cancel the order at no cost, as long as the order has not been processed for shipment.

If the order has been processed for shipment, the customer must bear the costs of shipping and handling associated with the canceled order.

When the cancelled order is subject to free shipping promotion, this promotion will be void and the customer bears the actual costs of shipping and return.

The client will have a maximum of 60 calendar days from its order confirmation to notify its desire of cancelling the order. Nutri-Cosmetica.com reserves its right to accept any cancellation subsequent to that period.

In any case, to proceed with the cancellation of an order the customer must notify his desire to cancellation to Nutri-Cosmetica.com. For a proper recording of the cancellation request, the customer must communicate it via e-mail (info@nutri-cosmetica.com) or via the contact form offered on our website. Once we had received the cancellation request, Nutri-Cosmetica.com shall notify the customer the receipt of the cancellation request and from that moment the cancellation process will start.

If the order is cancelled before shipping process, the refund of the corresponding amount will be processed in a shorter period than 48 hours working after confirmation of the cancellation request and using the same payment method used by the client.

If the order is cancelled after shipping process, the refund of the corresponding amount will be processed in less than 48 working hours after Nutri-Cosmetica.com has received the products corresponding to the canceled order and after checking that the returned merchandise is in perfect condition. If a refund is appropiate, Nutri-Cosmetica.com will perform the refund of the order minus the corresponding shipping and handling cost.

8.3 Return due to any other reasons

The Customer declares to be informed and agree in accordance with article 4.5 of Royal Decree 1906/1999 which regulates telephone and electronic contracting with general conditions and Article 45.c of the Law 7/1996 of distance selling.

The customer agree that there is a period of 14 working days after recieving the order to comunicate a withdraw of all or part of the purchased products under the following conditions:

  • The products must be in their original packaging with all of their accessories and intact seals
  • The products must be unused
  • The products must be in perfect conditions

After receiving the returned products, Nutri-Cosmetica.com will verify the previous conditions and will determine the entitled to the corresponding refund of the paid amounts. In any case, the customer must assume the total costs of the management fees and shippings that would have been generated during the purchase and the return process. 

Nutri-Cosmetica.com reserves itself the right to refuse a returned item if the return is communicated or sent after the deadline or if products are not in the same conditions as when they were shipped.

8.3 Return due to a missing or harming shipment during shipping

Our shipments are insured in many of the delivery destinations under the coverage offered by the contracted transportation service.

However, if the carrier agency does not admit a shipment insurance for the delivery destination, we will duly inform our customer via email and will request its agreement to proceed with his agreement to proceed with the shipping.

In these cases the customer must assume that, in case of any loss or damage of the products during shipping process, they may not be subject to any claim because the products will not be covered by any insurance. If the customer doesn't agree with these conditions, we will offer the opportunity to cancel the order and get reimbursed.

For those cases where the shipment is covered by shipping insurancewhen a packet is lost, then the client can reclaim the equivalent amount of the lost products and the cost of their transport. This refund will be processed directly by Nutri-Cosmetica.com who in turn will claim a compensation to the carrier which performed the service.

The deadline to determine that a shipment is lost, is set by the transport agency, who will shall proceed with the reimbursement coverage.

8.4 How to start a RMA process

Returns will be managed by sending an email to rma@nutri-cosmetica.com or either through the contact form on our website. The communication must include the order reference and a detailed description of the reasons and the causes alleged for return.

It is advisable to provide with graphic proofs of any issue to facilitate the returning process.

Upon receiving the request, the RMA process will begin.

9. Duration of contract, waiver and service patches

This contract is to pay the shipping product and the customer of an e-mail with a description of the purchase.

Nutri-Cosmetica.com reserves the right to modify in any way the characteristics and conditions of its services, always with the aim of improving and providing a benefit to the Customer.

10. Obligations of the parties

Nutri-Cosmetica.com is committed to providing the CUSTOMER items and products that have been hired using the utmost care to deliver them, as well as take care of the maintenance of the facilities necessary for the operation of the network, thereby providing for a technical team and appropriate computer operations and logistics management, shipping and delivery of the purchase.

The Customer agrees to use the services available to them in good faith, without violating the laws of matter or infringe any third party rights, and the payment of the selected product in the time and manner set out in these conditions of sale and receipt at the place for delivery.

Nutri-Cosmetica.com not guarantee the availability of the service under this contract is continuous and uninterrupted, due to circumstances caused by problems in the Internet, computing device malfunctions and other unforeseen circumstances. So the Customer agrees to bear within reasonable limits the circumstances, so up claiming to Nutri-Cosmetica.com any contract or tort for any shortcomings, errors and use of the service.

11. Communications

All notices between the parties will be done by email. The Customer is responsible for the confirmation of receipt of the notifications and Nutri-Cosmetica.com to inform any changes on your data, leaving it exempt from any liability for this circumstance. When changing the Customer shall immediately notify Nutri-Cosmetica.com by e-mail or telephone numbers on our website.

In compliance with article 21 of Law 34/2002 of Services of the Information Society and Electronic Commerce, we inform you that any commercial information relating to our website wil be made via e-mail to the e-mail adress that you provide. In any case, you have the option to reject our commercial communications by sending an email to the address baja@nutri-cosmetica.com adding "unuscribe" at the subject.

12. Commitment, acceptance and validity of the contract

As indicated in the privacy policy of our website, the Customer is responsible for providing their data is accurate and truthful, as well as updating them.

The Customer acknowledges having read and accepted the legal terms of use and privacy policy of the website.

The Customer acknowledges that it has understood the information regarding products and delivery service offered on our website, as well as all the conditions and stipulations contained in this electronic contract, making claims that are sufficient to exclude the error on the consent of this contract, and therefore, integrates and expressly accepts them.

The Customer is aware that the acceptance and execution of this contract will take place through the provision of data and pressing the button "Confirm order" indicated on our website and will be refined with the payment of the service.

13. Applicable Regulations

This contract is commercial in nature, and shall be governed and construed in accordance with Spanish and European Union law.

In the event that there is any discrepancy or difference between the parties regarding the interpretation or execution of the contract content, not settled by mutual agreement, the parties may choose to go, expressly waiving any other jurisdiction that could correspond to the Courts of Barcelona.

14. Personal information

In compliance with Law 15/1999 on Protection of Personal Data, we inform you that the personal data you provide to make the hiring process and those derived from the provision of services are confidential and will be added to a private file storage to be used under Nutri-Cosmetica.com responsibility in order to provide the contracted items and transmit business information of our products, including electronic mail.

We also inform you that your data is treated internally and applying safety measures regulated in Royal Decree 1720/2007, and are not published or passed to third parties to be used for commercial or promotional purposes.
